Key takeaways

  • Treasury is implementing a bipartisan housing law passed over the summer.
  • Large institutional investors will face a ban on buying single-family homes.
  • The purchase restriction begins Jan. 7, 2027.
  • Certain transactions will be excepted from the restriction.

Treasury moves to implement housing law

The Treasury Department on Thursday moved to put parts of a bipartisan housing law passed by Congress over the summer into effect. The department is codifying a restriction on purchases of single-family homes by large institutional investors.

Under the impending regulations, a large institutional investor cannot buy a single-family home beginning Jan. 7, 2027. The restriction includes certain exceptions, meaning the regulations will not prohibit every purchase involving those investors.

The effective date leaves a period between Treasury’s action and the start of the purchase restriction. Until Jan. 7, 2027, the new federal ban will not be in force.

What the change means for home purchases

The policy targets who may purchase single-family homes rather than setting home prices or guaranteeing that an individual buyer can complete a purchase. Its direct effect is to remove large institutional investors from some future transactions covered by the law and Treasury’s regulations.

The measure applies specifically to large institutional investors and single-family homes. It does not amount to a prohibition on every investor purchase because the law and regulations allow certain exceptions.

Political timing

Treasury’s move comes ahead of the midterm elections, but the restriction itself is scheduled to begin on Jan. 7, 2027. Congress approved the underlying housing law with bipartisan support over the summer, and Treasury is now carrying out its provisions through department regulations.

The next stage is the completion and implementation of those regulations, including how Treasury applies the law’s exceptions when the restriction takes effect.

What to watch

  • Completion of Treasury’s regulations
  • How the exceptions are applied
  • Implementation before the Jan. 7, 2027, effective date
